Terms of Service

1. Agreement

By creating an account, adding crew members, or running an inspection, the company you represent (“you”) agrees to these terms. If you are accepting on behalf of a company, you confirm you are authorized to bind it.

2. What the service does

InspectStream transmits live video and audio from an inspector’s device to an invited viewer’s browser, records the session, and retains the recording and any still images in private storage for a period you select. It provides an account for your crew, a record of past inspections, and administrative reporting.

3. What the service is not

InspectStream documents what an inspector sees and shares it with an invited viewer. It does not prepare, negotiate, adjust or advise on insurance claims, determine liability or causation, certify code compliance, or substitute for the judgment of a licensed professional. Any conclusion drawn from an inspection is yours.

If your work touches insurance claims, you are responsible for staying inside the limits of your own licence. Public adjusting is a licensed activity in most states and InspectStream is not a public adjusting tool.

4. Recording consent — your responsibility

This is the most important obligation in these terms. The service records audio as well as video, frequently inside private residences and other places where people have a reasonable expectation of privacy.

Recording law varies by state. Some states permit recording with the consent of one party to the conversation. Others — including California, Florida, Illinois, Pennsylvania, Washington, Massachusetts, Michigan, Maryland, Montana, Nevada, New Hampshire, Connecticut and Oregon — require the consent of every party. Recording without required consent can be a criminal offence as well as a civil one.

You are responsible for obtaining every consent the law requires wherever you operate, from the property owner, the occupants, and anyone else whose voice or image may be captured. The service displays a recording notice to invited viewers and records their acknowledgement, which helps — but it reaches only the person who opened the link. It does not reach anyone standing beside the inspector, and it is not a substitute for asking.

You will not use the service to record anyone covertly, and you will stop recording if asked to by someone whose consent is required.

5. Accounts and access

Crew accounts are created by your administrator, who chooses the initial password. You are responsible for who you give access to, for removing access promptly when someone leaves, and for everything done under your accounts. Do not share crew credentials. Tell us at once if you believe an account has been compromised.

Your plan includes a number of seats. Adding crew beyond that requires an upgrade.

6. Acceptable use

You will not:

• use the service to record anyone without the consents described in section 4;
• use it for surveillance, monitoring of individuals, or any purpose unrelated to documenting an inspection you have been engaged to perform;
• attempt to access inspections, recordings or accounts belonging to another company;
• probe, scan or test the security of the service, or attempt to guess or enumerate inspection links;
• resell or sublicense access, or attempt to rebuild the service from it;
• upload unlawful content or anything that infringes another person’s rights.

7. Viewer links

An inspection produces a short link that you send to your client. Anyone holding that link can watch the inspection until it expires or you end the inspection. Send it only to the person it is meant for. Ending the inspection revokes it immediately.

8. Your content

Recordings, photographs, property details and job references belong to you. We claim no ownership of them. You grant us the limited licence needed to host, transmit, record, store and display them so the service can function, and for no other purpose. We do not use your recordings to train machine learning models, and we do not sell them.

You confirm you have the rights and permissions necessary for us to process the content you put into the service.

9. Fees and plans

Paid plans are billed in advance for the period selected and are non-refundable except where required by law. If payment fails, your account may become past due: you will keep read access to inspections you have already recorded, but will not be able to start new ones until the account is brought current. Locking you out of documentation you have already paid for is not something we do.

Prices may change with at least 30 days’ notice before a renewal.

10. Availability and no warranty

The service depends on mobile network coverage, third-party infrastructure and the inspector’s device. Streams drop, phones die, and connections fail on roofs. Recording may occasionally fail even when the live stream succeeds. We do not offer an uptime commitment, and the service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Do not rely on this service as your only record of an inspection where the outcome matters. If a recording would be critical evidence, capture it a second way as well.

11. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business or lost data. Our total liability arising out of or relating to the service will not exceed the amounts you paid us in the twelve months before the event giving rise to the claim.

Nothing in these terms limits liability that cannot be limited by law, and nothing limits your liability under section 4.

12. Termination and what happens to your recordings

You may cancel at any time. We may suspend or terminate an account that breaches these terms, and will give notice where it is reasonable to do so.

After termination you have 30 days to export your recordings and images. After that period we may delete them permanently. Deletion is irreversible. Export your inspections before you cancel.

13. Changes

We may update these terms. Material changes will be notified to account administrators at least 30 days before they take effect, and continued use after that constitutes acceptance.

14. Governing law

These terms are governed by the laws of the State of Minnesota, without regard to its conflict of law rules. The state and federal courts located in Hennepin County, Minnesota have exclusive jurisdiction, and both parties consent to that venue.
